We are BooM Adventures and our agreement with you sets out what we can expect from each other when you book an adventure with us.
When you book with us you’re accepting our agreement on behalf of everyone travelling with you. We’ll only deal with you, the lead name, and you must be an adult when you book. Anyone aged under 18 must be accompanied by an adult.
Our agreement, and the details of your accommodation and services provided and/or booked in the booking confirmation, forms the entire agreement between us for your booking.
Information
You must give us correct information for your booking, including information relating to all those travelling with you, you must tell us if any of this changes. By providing other people’s personal data, you must ensure they agree to share their data with us, this is your responsibility. All information provided by you will be used in accordance with our Privacy Notice. It’s your responsibility to comply with all passport, visa, immigration and insurance requirements.
If you give us your e-mail address, we’ll contact you that way.
You must pass on any important information we give you to everyone on your booking.
If you require any special requirements, you must tell us before you book and if this changes tell us at least 78 hours prior to your departure.
The price
You’re required to pay your booking in full at the time you book your trip with us. If payment is not received, we reserve the right to treat your booking as cancelled and we may charge you cancellation fees.
When you book your trip with us, we’ll send your booking confirmation within 14 days. Unfortunately, mistakes can happen, so if any price on your booking confirmation, our website or provided to you on the phone is obviously wrong, a booking made on that price won’t be valid, we can cancel it and refund you unless you want to pay the correct price.
If prices increase due to circumstances out of our control we will do our best to absorb this increase, however if the increase is more than 5%, you may cancel your trip within 14 days of us telling you about the increase and we’ll refund you the booking price paid, except any additional charges and amendment fees.
Changes to your booking
Changes made by you
There may be times when you would like to change your booking. We are happy to make changes for you and/or your party, but we reserve the right to charge you an amendment fee for our time in doing this for you.
We ask that you notify us as soon as possible of your change, although please note that the time of your amendment and the fee incurred will be from the time we are able to confirm your request, not when you notify us. Please therefore ensure you give us plenty of notice.
The amendment fee charged is shown in the table below. If your change results in a cancellation, the fee will be a cancellation fee. If your change results in the booking being more expensive, you will need to pay the fee and the difference in price.
Some service providers may charge a fee for amendments or classify an amendment as a cancellation, this is out of our control. In the event of this happening please note that fees therefore may be 100% of the price for that part of your booking. You will be required to pay those fees as well as the amendment fee shown in the table below.
Amendments made will be based on prices at the time the change is made. If your amendment means fewer adults staying in your accommodation and your booking is based upon the number of adults, we’ll recalculate the total price and the price per person may increase. You will also need to pay the appropriate proportion of the termination fee for the adult who has cancelled.
Please note, some elements of your booking may be non-refundable and some amendments such as the room/board upgrades and late checkout rooms may not be changed.
You may transfer your booking to someone else but you must contact us as soon as possible and at least 7 days’ prior to your departure to do this. Please note, even if the booking is transferred to someone else you will still be responsible, together with the new lead name, for the amendment fees and any costs as a result of the amendment.

If you cancel your booking
If you need to cancel your booking, please let us know as soon as possible.
You must pay a cancellation fee for your cancellation, which is based on how long before your arrival you tell us you want to cancel. This is a percentage of the total price of your booking.

Even if your cancellation fee is lower than the deposit you won’t be refunded your deposit.
If we cancel your booking
We hope this shouldn’t happen but in the event we have to cancel your booking (except when you haven’t paid or you’ve been disruptive) you will be entitled to a refund or a replacement trip of a similar standard and price if we’re able to offer you one, at our sole discretion.
If we amend your booking
We pride ourselves in giving you what you’ve booked but, sometimes things can unfortunately change. We reserve the right to make a change at any time but will let you know before your departure if there’s time.
Events beyond our control
We shall not be in breach of our agreement with you nor liable to you for any delay in performing the agreement or our failure to perform any of our obligations under it if such delay or failure result from events, circumstances or causes beyond our reasonable control. This includes if such failure is due to the theft of bicycles or injury as a result of cycling or participating in an activity either on or off road and in particular injuries as a result of either inadequately maintained and serviced personal equipment or failure to wear the correct safety equipment such as protective gear and helmets.
During your stay
Your accommodation provider may ask you for a deposit for each villa or room upon arrival to cover damages or additional cleaning. Any damage caused will be covered by this deposit in its totality, however we also reserve the right to charge you or reclaim from you any additional fees and expenses incurred. This deposit must be paid by credit card and will be returned by the accommodation provider once they are satisfied with the condition of your villa/room. The amount of the deposit for the Grand Luxor is €150.
Behaviour
Only you can use your accommodation. No-one else can stay there. You’re responsible for any damage to your accommodation, its contents and/or its amenities during your stay.
We can refuse to accept you or continue to deal with you if we, or another person in authority, believes your behaviour (by any form of communication or in person) is disruptive.
If you’re disruptive during your adventure with us we can remove you from your accommodation. If this happens you won’t be entitled to any refund or compensation or meet any of your costs or expenses.
If you’re disruptive you’ll be responsible for all damages caused, including all costs and expenses (including legal expenses) incurred as a result, including for example cleaning, repairing or replacing property lost, damaged or destroyed by you, compensating any guest, members of staff or agent affected by your actions.
Disruptive behaviour includes being threatening or abusive, damaging property, upsetting, annoying or disturbing any guest, members of staff or agents or putting any of them in danger.
Should things go wrong
We hope that everything goes as planned, however in the unlikely event of anything else happening we will do our best to help you as much as we can, if we can. All we ask is that you let us or the hotel know straight away so they and we can resolve the issue.
Property
We take pride in taking care of your equipment and property and will take reasonable care when transporting your equipment, bikes and property, however your equipment, bikes and property is still ultimately your own risk and responsibility. No risk for any loss or damage or responsibility, financial or otherwise, can be accepted by BooM or by a third party during your trip at any time. Please ensure that your property is adequately insured.
Risk and Insurance
By booking your adventure with us you are booking with the knowledge of the numerous risks and dangers involved, or any other actions, omissions, or conditions outside the control of BooM. You acknowledge that many trails are not manicured, monitored or maintained and can change day to day due to the nature of the environment. You accept that mountain biking can be hazardous and may involve elements of risk or discomfort and that you take personal responsibility for your own actions and safety.
You must at all times participate within your own ability and always wear approved safety equipment, including a mountain bike helmet, eyewear, gloves, knee, elbow pads. This is not exhaustive and you are responsible to use your own judgement on wearing your own suitable safety equipment.
You are responsible and take personal responsibility for your own bike, components and equipment, personal clothing and protective equipment, maintenance and checks at all times, whether routine or otherwise.
You must ensure that you are fit and well and capable to participate in all activities. It is your responsibility to inform us of any medical conditions, restrictions or injuries you may have or which may develop during your trip which may affect your participation.
It is your responsibility to ride within your comfort zone and within your skill level/ability.Whilst our guides endeavour to ride at your ability and level, they can not be held responsible for any actions you make while riding in their group. You must ride sensibly and follow the guidance of the guides and suppliers at all times.
It is a requirement of your booking for you to take out appropriate and adequate insurance to cover yourselves, your party, your belongings and equipment for all sports and activities you intend to take part in as well as for extra costs and charges incurred from delays, cancellations, rescheduling, repatriation or any other factors outside BooM’s control. We may ask for you to send us your policy details prior to the departure for your trip.
Please also be aware that your accommodation is provided by suppliers who follow local standards. Overseas safety standards may differ from the country you are from. If you or anyone you are travelling with suffers injury, illness or death while you’re staying at the accommodation we have booked for you, you must tell us and the accommodation provider straight away. We have no direct control over the way the accommodation providers maintain and operate their properties.
We use vehicles with seat belts fitted. It is your responsibility to wear seat belts at all times required. It is also your responsibility to keep your bike in a safe and working order.
Liability
BooM shall not be liable for any damages caused by the total or partial failure to carry out the trip if such failure is attributable to anyone other than us; unforeseeable or unavoidable and attributed to a third party unconnected to us; as a result of unusual or unforeseeable circumstances, reasonably beyond our control; a result of an event which we or any of our agents, even with all due care, could not foresee. BooM, its owners, employees, affiliated entities, agents, representatives, officers, directors, associates, volunteers, successors and assigns, act only as an intermediary for its suppliers and assumes no responsibility for and cannot be held liable for any negligent or wilful act or omission of any supplier, or of any other person or entity.
Any independent arrangements you make which are not part of the trip are entirely at your own risk.
The accommodation provider and/or other supplier’s services are subject to their own terms and conditions, as well as the local laws and regulations of the relevant country.
BooM takes no responsibility for damage, death or personal injury caused to you or by you as a result of participation in any activity.
Confidentiality
All information, including contact details, supplied to us by you will remain confidential and will not be shared with any third party companies or organisations, unless it is to be used to fulfil our agreement with you and assist in delivering the booked services. Your data will be used in accordance with our Privacy Notice.
Content
Photographs and videos: any likeness or image of you secured or taken on any of our trips may be used by BooM without charge in all media (whether now existing or in the future) for promotional purposes.
Changes to these terms and conditions
We reserve the right to update and/or amend these terms and conditions at any time at our own discretion. Once amended, the new terms and conditions will replace the terms and conditions on our website and will automatically apply to you with immediate effect. It’s your responsibility to be familiar with these terms and conditions for yourself and your party.
Miscellaneous
This agreement is made under the laws of England and Wales. You submit to the exclusive jurisdiction of these courts.
